Discrimination based on obesity

The European Court of Justice (ECJ) has held in Kaltoft v Municipality of Billund that discrimination based on obesity is not necessarily unlawful, but an obese person is protected under European law if they meet the normal definition of ‘disability’. The judgment is consistent with an earlier UK decision by the Employment Appeal Tribunal in Walker v SITA Information Network Computing, where the EAT said that being obese may make it more likely that someone is disabled.
